CONFIDENTIALITY AND DATA PROTECTION POLICY
Blacksmith is committed to protecting the personal data of its users. This personal data protection policy (hereinafter the “Policy”) outlines Blacksmith’s obligations as a data controller to ensure the proper handling of your personal data.
Through this GDPR Policy, Blacksmith aims to clearly inform you about how your personal data is collected and used when you, as a User, register on our Site to benefit from the Services described in the General Terms of Service (GTS) of Blacksmith, of which the Policy forms an integral part.
Capitalized terms refer to the definitions established in the General Terms of Service.
Blacksmith may make changes to its GDPR policy, particularly due to changes in applicable legislation or changes within the company structure.
In general, the Privacy Policy is always accessible on the Blacksmith website. What data is processed? Blacksmith only collects data that is strictly necessary for the purpose for which it is processed.
The processing of the collected data enables the tool to generate amicable settlement documents, as well as a complete case file for submission to the Jurisdiction.
When your data is collected, the necessary nature of the information is indicated by an asterisk or any other equivalent method.
Failure to provide this data will result in Blacksmith being unable to process your request. We do not collect all of this data for each of our offers; part of the collected data is specific to certain disputes.
The information that may be collected includes:
Your identity (name, first name, maiden name, place of residence, nationality, profession, email address, phone number, date of birth, title, place of birth, place of work, employer’s identity, salary, duration of employment contract, reason for termination, amount of rental income, customer number with the opposing party).
The identity of your company, legal entity (SIRET, date of creation, city of registration, SIRET number, SIREN number, registered office location), information related to your project (project name, sector, details, budget for the project, personas, mockups, specifications, etc.).
Other data may be included but is not expressly requested and is not stored in a structured manner in our databases.
In accordance with the principle of data minimization (Article 5.1.c. of the General Data Protection Regulation), Blacksmith emphasizes the importance of only providing data strictly necessary for the creation of quotes via free text fields.
The User should refrain from sharing “sensitive” data that is neither justified nor proportionate to the intended purpose.
For security purposes and to limit the number of daily registrations by the same user, the IP addresses of Users are also recorded. These data are not used for personal identification or profiling of the User, but only for the protection of the site and its Users. What are the purposes of processing personal data? Blacksmith processes data for necessary and legitimate purposes based on the performance of a contract, compliance with a legal or regulatory obligation, or your consent.
The data processing requested by Blacksmith is essential for providing Blacksmith’s services and/or for complying with legal and regulatory requirements to which Blacksmith is subject. Outside of these cases, Blacksmith does not collect any data without the user’s prior consent.
Blacksmith collects and uses your personal data for your access to the Sites and for the purpose of providing the Services described in the General Terms of Service. Who are the recipients of the information we collect? Blacksmith may share your personal data with its partner service providers, whose involvement may be necessary to achieve the purposes mentioned above.
Blacksmith ensures that these third parties process your data in a manner that guarantees its integrity, confidentiality, and security.
Your data will not be transferred for purposes other than those described in this Policy, except with your consent, which can be withdrawn at any time. How long is personal information retained? Your personal data will be retained for the time necessary to fulfill the purpose for which it was collected, as mentioned below.
Data is retained according to the following cycle: Data necessary for the creation of the file, performance of the service, and follow-up of the case will be retained for 2 years after the last interaction between the user and our applications. Access to this data is then restricted for a period of 3 years: archived in a partitioned environment, only a limited number of administrators can access it. After this period, the data may be anonymized for statistical analysis or research and development purposes, except for data necessary for compliance with legal retention obligations, such as invoices issued by the Company to the Client. How is data secured? Blacksmith ensures the security of your data by implementing enhanced data protection through the use of technical, physical, and logical security measures to guarantee the integrity of your data, as well as its confidential and secure processing.
Use of cookies
As part of the use of the Service, Google Analytics cookies are set.
Google Analytics is a web traffic analysis service. Web traffic analysis involves the collection, gathering, and analysis of data regarding visitors' behavior on websites. A web traffic analysis service collects, among other things, data about the website from which the visitor arrives (referring site), the sub-pages visited, or how and for how long the sub-page was viewed. Web traffic analysis is mainly used for website optimization and to perform a cost-benefit analysis of internet advertising.
Google Inc., located at 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, in the United States, operates the Google Analytics component.
Google Analytics allows us to evaluate the use of our website, provide online reports showing activities on our sites, and analyze website traffic.
Google Analytics places a cookie on the web browser of the concerned person. Using this cookie, Google can analyze the use of our website. Each time one of the pages of our website is visited, the internet browser of the user's computer system is automatically prompted by the Google Analytics component to send data to Google for web traffic analysis. During this process, Google collects personal data, such as the IP address of the user, which is used to understand the origin of traffic and clicks from visitors.
The cookie is used to store personal data, such as the location of access, the frequency of visits to our site, or the time of access by the visitor. With each visit to our website, this data is transmitted to and stored by Google, whose headquarters are located in the United States of America. Google may transmit this personal data to third parties.
The user can prevent cookies from being stored by our website at any time by adjusting the settings of their web browser, thus permanently blocking cookies. Such a browser adjustment would also prevent Google Analytics from placing a cookie on the user’s computer system. Additionally, cookies already set by Google Analytics can be deleted at any time through a web browser or other software programs.
Moreover, the user can object to the collection of data generated by Google Analytics regarding the use of this website, as well as to the processing of this data by Google. To do this, the user must download and install a browser extension from the following link: https://tools.google.com/dlpage/gaoptout.
This browser extension informs Google Analytics that no data or information regarding visits to web pages may be transmitted to Google Analytics. Installing this browser extension is considered an objection to the collection of data by Google. If the user’s computer system is later deleted, formatted, or reinstalled, the user must reinstall the browser extension to disable Google Analytics. If the browser extension is uninstalled or deactivated by the user or any other person authorized to do so, it can be reinstalled or reactivated.
